This agreement is made and hereby entered into on this the ______ day of _____________, 20____ by and between the following parties: Jackie Drake hereafter referred to as “seller” or “breeder”, and
_____________________________________ referred to as “buyer”, for the purpose of setting forth the terms and conditions of the purchase by the buyer of herein described poodle.

You would agree to keep the puppy healthy and happy, this would mean shots and worming, and regular grooming. Vet. Care as needed. You need to have the puppy checked by your vet. within 72 hours of receipt. The Seller warrants that the above-described puppy is in good health and free of communicable diseases at the time Buyer assumes ownership. You will be getting a healthy puppy. Failure to get a health check in 72 hours will void all health guarantees implied or stated within this contract. Seller is not responsible for any veterinarian expenses incurred at any time. If you don't get your pup checked in the 72 hours and they become seriously ill or pass away you will not get a replacement puppy.
I cannot and will not guarantee size and or color of puppies, I suggest waiting until the pup is 10 months old to see what color and size to register under. All our puppies are considered pet quality unless otherwise noted.
You would agree to keep us informed of your address and phone #, throughout the life of your puppy. As the breeder I would also keep you informed of any address or phone # changes so you can always call me with any questions you might have regarding your puppy. Photos would be appreciated!!
You would agree to keep the name "Drake's" in the pups registered name.
Limited Registration: The pup would be in your name, you would receive the registration papers after the puppy was neutered/spayed at around 6 months of age and a copy of the vet. bill with a description of the dog sent to me.
Full Registration: The pup would be in your name and mine. I would receive no further monies from sale of pups from your dog. The pup would not be bred until at least 2 yrs of age when it is more mature. And not past the age of 8 yrs. The reason I do this is to make sure the pup is not over bred, or bought by a puppy mill or bred every single heat, its unhealthy and unfair. I would need to sign off on litter registration papers to be sure of this. I agree to never withhold signing if the dog is of age, not past age, and not bred on consecutive heat cycles. It would be considered a breach of contract if the dog was bred and the puppies not registered to avoid conditions of this contract.
At no time will this puppy or its progeny be registered under any club other than AKC.
The Buyer agrees that the puppy will NOT be left alone in a backyard or kennel only. The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, or not be chained or "tied out" and left. Nor live in small cages or crates, except for appropriate crate training or house training. They will always have access to food and water. This animal is sold with the understanding that it will live indoors, be socialized properly, and become a member of the family. Buyer agrees to maintain this dog in a healthy safe environment.
The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of its progeny to any agent, pet store, or other dog/pet business, or research institution where experimental practices take place.
NO CASH REFUND IS EVER MADE. A replacement puppy will only be given due to a life threatening genetic illness with the pup returned to the breeder, or if the puppy had to be put down or dies from said genetic illness within 1 year of purchase. A necropsy report would need to be sent to breeder, and agreed to by breeders vet. that the pup died of a genetic defect. If a replacement puppy is required we will provide one as soon as we have one of equal value and quality available from another line.
If for whatever reason you find that you cannot keep or do not want this dog you *must* contact us, the breeder Jackie Drake so said dog can be returned to said breeder, or other new owners agreed upon by the breeder. Such approval will not be unreasonably withheld, on condition that the new owner agrees in writing to be bound by all of the provisions of this contract. Should the dog be returned to the breeder AKC registration will be transferred back to the Breeder(s). Should we be able to re-homed said dog the owner would receive any funds received by us minus any reasonable expenses incurred while maintaining the dog until being re homed. However, should I simply have to find a loving home with no moneys exchanged for an older dog the owners or breeder shall receive no money. We brought this dog into the world through selective breeding and you took this dog into your home; we are both responsible to do all we can to give him a safe, healthy, happy and loving home for life. If it is impossible to return the dog to us, through our deaths then the dog must be turned over to a Poodle Rescue group.
This binding contract is signed by both the Seller and the Buyer for the well being of the said puppy. If any part of this contract is breached by the Buyer, the seller can and will repossess the puppy.
Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court fees. All legal proceedings will be held in the breeder’s county of residence.
By signing this binding contract you understand and agree with all three pages and all provisions within.

I've had people get mad at me because of my contract, they think it is awfully strict. If your intentions are good then there would never ever be a problem. No, I don't sneek around your house or do home inspections. AKC was quoted as saying "Its the contract of a responsible breeder." Some parts are negotioable. I have had to enforce it due to an unscrupulous person who bred a baby twice before she was 15 months, mistreated her, and forged my name. This angel was returned to me and now has a wonderful forever home where she will be treated with all the love and attention she deserves.
